DISTANCE SELLING AGREEMENT

1. PARTIES

This Distance Selling Agreement is entered into electronically between the Seller, whose details are set out below, and the Buyer/Consumer who shops through the www.sapheen.com website, within the scope of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is the sale and delivery of the product or products ordered by the Buyer electronically through the www.sapheen.com website belonging to the Seller, the payment terms, the right of withdrawal, and the determination of the rights and obligations of the parties.


3. PRODUCT INFORMATION

The essential characteristics, sale price, payment method, delivery information, and, where applicable, shipping fee of the product or products purchased by the Buyer have been displayed to the Buyer before the order is completed and approved by the Buyer electronically.

Product information appears on the order summary and on the invoice/delivery note.


4. PAYMENT INFORMATION

The Buyer pays the price of the product or products purchased using one of the payment methods offered on the website.

The payment method, total product price, shipping fee, and any additional charges, if applicable, are clearly displayed to the Buyer before the order is completed.

The Seller is not obliged to ship the product until the payment transaction has been completed.


5. DELIVERY

The Seller ships the product subject to the order to the delivery address specified by the Buyer at the time of order.

The product is handed over to the carrier as soon as possible, depending on stock availability and shipping conditions. Delivery time may vary according to the nature of the product and the Buyer's address.

If the product packaging is damaged, crushed, torn, or opened during cargo delivery, the Buyer is advised to have a report drawn up with the courier before accepting delivery of the product.


6. RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the distance sale within 14 days from the date of receipt of the product, without giving any reason and without paying any penalty.

To exercise the right of withdrawal, the Buyer must notify the Seller in writing or through a durable data storage medium within the 14-day period.

7. CASES IN WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

  1. Products prepared specifically at the Buyer's request or in line with the Buyer's personal needs,
  2. Products containing custom sizing, names, letters, symbols, engraving, or bespoke design,
  3. Products that are not suitable for return for hygiene reasons and whose packaging has been opened,
  4. Products that have been used, damaged, or have lost their resaleability,
  5. Products whose packaging, tape, seal, or protective elements have been opened after delivery and whose return is not suitable for health/hygiene reasons.

For jewelry, costume jewelry, accessories, and similar products, the product must be returned unused, undamaged, and together with its original packaging and, where applicable, its certificate/invoice.


8. RETURN PROCESS

If the Buyer exercises the right of withdrawal, the product must be returned to the Seller unused, undamaged, in a resalable condition, and together with all accessories, packaging, invoice, and, where applicable, certificate.

Carrier to be used for the return process: Shipentegra

The return process is reviewed after the product reaches the Seller. If the product is in a condition eligible for return under the right of withdrawal, the payment is refunded through the method used by the Buyer.

The Seller completes the refund within the statutory periods from the date the withdrawal notice is received.


9. SHIPPING AND RETURN SHIPPING FEES

The shipping fee for order delivery is displayed to the Buyer before the order is completed.

For returns made under the right of withdrawal, the Buyer must carry out the return process through the return method specified by the Seller and via Shipentegra.

If the Buyer uses a carrier other than the return method specified by the Seller or a different shipping method, any additional costs that may arise shall be borne by the Buyer.


10. PRODUCT EXCHANGE

The Seller may exchange products depending on stock availability. For exchange requests, the Buyer must contact the Seller.

Exchange is not available for products that have been used, damaged, custom-made, or have lost their resaleability.


11. INVOICE

The invoice for the order is issued according to the information provided by the Buyer at the time of order.

The Buyer accepts that the invoice information is accurate and complete. If there is an error in the invoice information, the Buyer must contact the Seller without delay.


12. BUYER'S OBLIGATIONS

The Buyer accepts that the information provided when placing an order through the website is accurate and up to date.

The Buyer accepts that, before confirming the order, they have read and understood the product characteristics, sale price, payment terms, and delivery conditions, and have approved them electronically.

The Buyer is obliged to inspect the product upon receipt and to notify the Seller within a reasonable time if there is any damage or deficiency.


13. SELLER'S OBLIGATIONS

The Seller is obliged to deliver the product subject to the order to the Buyer in accordance with the agreement, complete and in the stated characteristics.

The Seller informs the Buyer about products that are out of stock or cannot be delivered and, where necessary, refunds the payment.


14. PRIVACY AND PERSONAL DATA

The Buyer's personal data is processed for the purposes of receiving the order, carrying out payment transactions, product delivery, issuing invoices, and conducting customer service processes.

15. RESOLUTION OF DISPUTES

In disputes arising from this agreement, Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or where the consumer transaction was made are authorized, within the monetary limits announced by the Ministry of Trade.


16. EFFECTIVENESS

By completing an order through the website, the Buyer declares that they have read, understood, and accepted this Distance Selling Agreement electronically.

This agreement enters into force on the date it is approved electronically by the Buyer.
